An increasing number of entrepreneurs and private individuals are encountering the Bibob Act (Public Administration Probity Screening Act). Our Bibob team leverages extensive experience in this area alongside our expertise in both administrative and criminal law. This valuable combination enables our Bibob specialists to respond swiftly and take the appropriate actions on your behalf.

The Bibob law is an important administrative tool for government bodies. The powers granted by the Bibob Act enable government agencies to protect their own integrity by preventing the government from unintentionally facilitating criminal activities.

Experience shows that this law is not primarily applied to 'criminal organizations'. In practice, it is often private individuals and entrepreneurs who face negative consequences under the Bibob Act. This can happen, for instance, due to an incorrectly completed Bibob form or a loan from, or business association with, a third party with a criminal record. In many cases, it is advisable to consult with the municipality. Our Bibob team can provide you with advice in this regard.

The Bibob law applies to the following different types of government decisions:

  • decisions (such as permits, exemptions, allocations, approvals, recognitions, registrations, and designations);
  • grants;
  • government contracts; and
  • real estate transactions.

The Bibob law can be applied within various sectors, including:

  • recreation and entertainment (such as hospitality, events, coffee shops, sex establishments, liquor stores, gaming machine businesses),
  • construction and real estate (such as building permits, real estate transactions, housing corporations, housing permits),
  • transportation (such as taxi companies and bus services),
  • environment and surroundings (such as waste storage and waste processing),
  • other (such as grants).

Seek timely advice

Given the numerous pitfalls in a 'Bibob procedure', it is crucial to seek advice at the earliest possible stage. Our Bibob team advises both government bodies and entrepreneurs or private individuals who are confronted with the Bibob Act. For instance, we assist with permit processes, including the completion of a Bibob form. This Bibob form is a critical starting point, and it is precisely here that things often go wrong, as the questions are not simple, and the form must be filled out with great accuracy.

Are you facing a potential refusal or revocation of a permit? If so, please contact us as soon as possible.
